Charges against a Florida man who shot a deputy last year could be dismissed if he is granted immunity.

Keenan Finkelstein, 24, claimed the Stand Your Ground defense for shooting Sgt. Shedrick Johnson in the leg outside a home in Scenic Hills on March 20. He is charged with aggravated battery against an officer.

The deputies came to a Scenic Hills residence looking for Finkelstein’s friend, Jonathan Chappell, 24, who allegedly robbed an acquaintance earlier in the parking lot of the Tom Thumb store at 6795 Pensacola Blvd. The victim said a man who was living at a home in the 8800 block of Burning Tree Road had stolen marijuana and a handgun from him during a drug sale gone wrong at about 6 p.m.

The victim identified the suspect’s home and a blue van parked on the street near the house’s driveway, according to an arrest report.

Johnson testified that under the cover of night, he observed the home from behind a tree in a neighboring yard. He said he saw someone, later identified as Finkelstein, come out of the home’s garage.

Under Stand Your Ground, those who are not involved in illegal activity have the right to meet force with force, even if its deadly to avoid death.

A ruling is expected today.
