Ramsey Orta filmed Eric Garner being choked to death by New York police officers. Orta is now facing four years in prison after taking a plea deal on gun and drug charges that he feels were brought against him in retaliation and plans to take the city of New York to prove it. There’s also $10 million on the line, according to the New York Post.

“Despite the murder of Eric Garner by the NYPD, Ramsey Orta, who filmed the incident, is the only person present at the incident who is going to prison because the NYPD engaged in smear tactics, in cooperation with the news media, and prepared a tactical plan to set him up for retaliatory arrests,” reads his Manhattan Supreme Court lawsuit.

A spokesperson for the city’s law department says they’ll review all of the allegations in Orta’s case while the alleged heroin dealer who also attempted to hide a gun in a woman’s pants in 2014 is expected to be sentenced in October.
