John Henry Spooner, the 75-year-old Milwaukee man charged with first degree homicide in the death of 13-year-old Darius Simmons, has pleaded not guilty.

Spooner admitted to officers who arrived on the scene that he had shot Simmons.

Authorities say Spooner’s home had recently been broken into and that he confronted the teen and demanded the return of the stolen items. Authorities say Darius replied that he didn’t have them, and then Spooner shot him in the chest in view of the teen’s mother.

Spooner has waived his right to a preliminary hearing, and has a scheduling conference on June 20.
